General terms and conditions of business

1. Scope of application

For the business relationship between JACKS beauty GmbH, represented by the managing directors Lisa Buchholz & Miriam Jacks, Danneckerstraße 8, 10245 Berlin (hereinafter "seller") and the customer (hereinafter "customer") concluded via the online shop www.jacks-beautyline.com, exclusively the following General Terms and Conditions in their version valid at the time of the order apply. Customers are either consumers or entrepreneurs, but only act as end customers.

A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities. An entrepreneur is a natural or legal person or a legally capable partnership who acts in the exercise of their commercial or self-employed professional activity when concluding a legal transaction.

2. Ordering process and conclusion of contract

The customer can select products from the seller's range without obligation and collect them in a so-called shopping cart by clicking the "add to cart" button.
Afterwards, the customer can proceed to complete the order process within the shopping cart by clicking the "Proceed to checkout" button.


By clicking the "Order with obligation to pay" button, the customer submits a binding offer to purchase the goods in the shopping cart. Before submitting the order, the customer can edit the data
change and view at any time. Required information is marked with an asterisk (*).

The seller then sends the customer an automatic receipt confirmation by email, which lists the customer's order again and which the customer can print using the "Print" function (order confirmation).

The automatic receipt confirmation only documents that the customer's order has been received by the seller and does not constitute acceptance of the offer. The purchase contract is only concluded when the seller ships, hands over the ordered product to the customer within 3 days, or confirms the shipment to the customer with a second email, explicit order confirmation, or sending of the invoice.

If the seller allows prepayment, the contract is concluded with the provision of the bank details and payment request. If the payment is not received by the seller within 10 calendar days after sending the order confirmation, despite a renewed request, the seller can withdraw from the contract, resulting in the order becoming void and the seller having no delivery obligation. The order is then completed for both the buyer and seller without further consequences. Therefore, a reservation of the item for prepayments is made for a maximum of 10 calendar days.

3. Contract language, contract text storage

The languages available for concluding the contract are German and English.

We save the contract text and send you the order data and our terms and conditions in text form. You can view the contract text in our customer login.

4. Prices, shipping costs, delivery information

The prices listed on the product pages in euros (€) include the current statutory value-added tax.
We deliver within Germany, EU member states, and Switzerland.

Discount codes are, unless otherwise stated, proportionally deducted from all products in the shopping cart. In case of a refund, the amount paid according to the invoice will be refunded.

National shipping
In addition to the stated prices, we charge 4.50 euros per order for delivery within Germany via DHL or 3.90 euros per order for delivery via DPD. The flat shipping rate includes the statutory value-added tax. For orders over €70.00, you will receive free shipping. 

Shipping costs are clearly communicated again in the shopping cart system and on the order page. All packages are insured against loss or damage during transport. All national packages are shipped climate-neutral (Go Green).

The average delivery time within Germany is 2-3 business days.

Shipping to EU countries
For deliveries to Belgium, Netherlands, Luxembourg, Austria, Denmark (excluding Faroe Islands and Greenland), Sweden, France, Spain, Monaco, Italy, the Czech Republic, Slovakia, Malta, and Portugal we charge a flat rate of 8.90 euros.
Shipping costs include the statutory value-added tax.
The average delivery time varies by destination country and is approximately 2 – 8 business days.

Shipping to Switzerland
For deliveries to Switzerland, shipping is done via Exporto. Delivery time within Switzerland is approximately 10 business days, unless otherwise stated. Shipping costs are as indicated in the shop.

For shipments to Switzerland, we take responsibility for proper customs declaration and any customs fees via our shipper Exporto, unless otherwise agreed.

Product prices for customers in Switzerland
The prices listed in our webshop apply to orders within the EU and differ for customers from Switzerland. Due to additional customs fees, import taxes, and higher shipping costs, prices for deliveries to Switzerland are higher. These additional costs are transparently displayed during the ordering process.
Please note that these price differences are due to legal regulations and logistical requirements for international deliveries, and we cover import and customs clearance costs.

5. Payment

In our shop, the following payment methods are generally available to you:

Credit Card
By placing the order, you provide your credit card details. After your authentication as the rightful cardholder, the payment transaction is automatically carried out and your card is charged.

PayPal
During the order process, you will be redirected to the website of the online provider PayPal. To pay the invoice amount via PayPal, you must be registered there or register first, authenticate yourself with your login data, and confirm the payment instruction to us. After placing the order in the shop, we request PayPal to initiate the payment transaction. The payment transaction is then automatically carried out immediately by PayPal. Further information is provided during the order process.

Purchase on Invoice via Klarna
In cooperation with Klarna AB (www.klarna.de), Sveavägen 46, Stockholm, Sweden, we offer you invoice purchase as a payment option.
Please note that Klarna invoice is only available for consumers and that payment must be made to Klarna. When purchasing on invoice with Klarna, you always receive the goods first and always have a payment term of 14 days. The full terms and conditions for invoice purchase can be found here. 

6. Transport Damage
If your package arrives damaged, please inform us of the damage within two business days of receiving the package. For processing, we need the following evidence:
  • a photo of the shipping label,
  • a photo of the outside of the package,
  • a photo of the damaged contents.
Please send this evidence by email to our customer service at support@jacks-beautyline.com. If the deadline is not met or documentation is incomplete, we reserve the right to reject the complaint.
For goods with obvious transport damage, please file a complaint directly with the carrier upon delivery and contact us immediately. Failure to file a complaint or contact us does not affect your legal claims or warranty rights. However, you help us assert our claims against the carrier or transport insurance.

7. Warranty and Guarantees

The warranty is determined according to legal regulations.
A warranty exists for goods delivered by the seller only if it has been expressly provided. Customers are informed about the warranty conditions before initiating the order process.

8. Returns and Exchanges

Only unopened and unused products will be accepted for return within two weeks. Products that have been opened and/or used are excluded from exchange and return.

In case of dissatisfaction, goods can also only be returned as long as they are still unopened and unused.

If an intolerance is present, the products cannot be returned. Please feel free to contact our customer service support@jacks-beautyline.com.

9. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find here found. We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

10. Place of Jurisdiction and Applicable Law

For all disputes with consumers (Section 13 BGB) arising from or in connection with this contract (including those about its validity) and all individual call-off orders, Berlin is agreed as the place of jurisdiction if the consumer does not have their general place of jurisdiction in Germany or other EU member states.
If the customer is a merchant, a legal entity under public law, or a special fund under public law, Berlin is agreed as the place of jurisdiction. This also applies if the buyer is an entrepreneur within the meaning of Section 14 BGB.

Severability Clause
If any provision of this contract is or becomes wholly or partially invalid or unenforceable, the validity of the remaining provisions of this contract shall not be affected. The same applies if and to the extent that a gap should emerge in this contract. Instead of the invalid or unenforceable provision or to fill the gap, an appropriate regulation shall apply which, as far as legally possible, comes closest to or corresponds to what the contracting parties economically intended or would have intended according to the meaning and purpose of this contract, if they had considered this point. This also applies if the invalidity of a provision is based on a scope of performance or time (deadline or date) provided for in this contract; in such cases, a legally permissible measure of performance or time (deadline or date) that comes as close as possible to the intended economic purpose shall replace the agreed one.

11. JACKS Club Loyalty Program

As part of the JACKS beauty line loyalty program ("JACKS Club"), the customer benefits from numerous advantages granted by JACKS beauty GmbH ("JACKS") to loyal private customers.

11.1. Participation

Participation in the JACKS Club is possible for natural persons who have reached the age of 18. Natural persons who shop in the webshop within the scope of their commercial or freelance activity cannot participate in the loyalty program.

Participation in the loyalty program is voluntary, free of charge, and only possible through the webshop.

Customers can benefit from the loyalty program by collecting points when purchasing products

-   in the webshop or

-   in the JACKS Store Berlin

collect. Points cannot be collected for purchases made elsewhere or with JACKS partners.

11.2. Registration

To participate, the customer must register at https://jacks-beautyline.com/pages/jacks-club. They may be asked to enter their name, email address, and password. They will then receive a welcome email at the provided email address, through which the membership must be actively confirmed by the customer.  

Once the membership is activated, the customer can view the products and benefits granted by the program at https://jacks-beautyline.com/pages/jacks-club and use them according to the conditions of the loyalty program.

11.3. Loyalty points, conditions, validity

After successful registration, the customer can collect loyalty points on product purchases mentioned in section 11.1.

On the membership page (accessible at https://jacks-beautyline.com/pages/jacks-club) the customer can always view the current amount and conditions under which loyalty points can be collected and redeemed. It is recommended to regularly visit the membership page before making a purchase to check the current values and conditions for earning and redeeming points. Furthermore, the number of points to be earned from each purchase is also displayed to the customer directly at the time of purchase. 

JACKS reserves the right to adjust or change the conditions for earning and redeeming points with reasonable notice. 

The loyalty points earned from a purchase are credited to the customer only after a period of 14 days following the order. If goods are returned by the customer, the portion of loyalty points corresponding to those goods will be deducted from the customer's points.

Collected loyalty points are valid for 12 months from the respective product purchase. The validity of the loyalty points held by a customer is automatically extended by 12 months with each purchase made by the customer in the JACKS webshop or JACKS Store Berlin. Once loyalty points have expired, they are irrevocably forfeited.

The customer can also view the current status of their loyalty points on the membership page (accessible at https://jacks-beautyline.com/pages/jacks-club) view. 

11.4. Benefits

The loyalty points credited to the customer can be exchanged within the JACKS Club loyalty program for numerous benefits, such as exclusive pre-sale promotions, instant discounts, or other advantages. In addition, benefits can also be granted due to membership in the JACKS Club for which no loyalty points need to be redeemed. 

The possible benefits can be claimed under the conditions each time on the membership page https://jacks-beautyline.com/pages/jacks-club are available for viewing. JACKS reserves the right to adjust or change the benefits granted through the loyalty program with reasonable notice. 

11.5. Termination and Unsubscription

The customer can unsubscribe from the loyalty program at any time without notice and with immediate effect by clicking on their account page under https://jacks-beautyline.com/account clicks on “unsubscribe from JACKS Club.” The customer can also contact support@jacks-beautyline.com apply. The processing of the unsubscription is then done manually and can take up to 5 working days.  

Unsubscribing from the loyalty program results in the loss of existing loyalty points, all benefits tied to the loyalty program, and the ability to earn loyalty points. However, it has no further impact on the other contractual relationship between the customer and JACKS.

JACKS can terminate or reduce the loyalty program after prior notification to customers and observing a reasonable notice period. In this case, customers will be given the opportunity to redeem their existing loyalty points within a reasonable period.

If a customer abuses the loyalty program, JACKS is entitled to terminate the customer's participation in the loyalty program without notice and to revoke the benefits associated with the program.

12. Recruiting and Applicant Management

Based on Art. 88 GDPR, §26 para. 1 in conjunction with para. 8 BDSG, we process your personal data to assess your suitability for a position (or possibly another open position in our company) and to carry out the application process. This assessment is only carried out to the extent necessary for the decision on establishing an employment relationship with us. Your personal data will be treated confidentially exclusively for the purpose of processing the application, i.e., solely for recruitment, hiring, and the creation of an employment contract, as well as to support internal job allocation. It is essential that employees of the HR department and the relevant specialist department have access to your personal data. If the data is possibly required for legal prosecution after the application process is completed, data processing may be based on the conditions of Art. 6 GDPR, especially for the assertion of legitimate interests according to 6 para. 1 lit. f GDPR. Our interest then lies in asserting or defending claims. The data from your application for a job posting will be deleted no later than 6 months after a rejection.

In the event that you have consented to further storage of your personal data, we will include your data in our applicant pool. The data will be deleted there no later than two (2) years after the last contact. You have the right to revoke your consent at any time with effect for the future.

If you receive a position as part of the application process, the data will be transferred to a personnel file.

We generally do not share your applicant data with external service providers. However, there may be a legal obligation to disclose data according to Art. 6 para. 1 sentence 1 lit. c) GDPR.

In exceptional cases (e.g., to reimburse the costs of the application process), we only share your data based on your consent (e.g., with our house bank).

After receiving your application, your applicant data will be reviewed by the responsible HR officer. Suitable applications will then be forwarded internally to the department heads responsible for the respective vacancy. Subsequently, the further procedure will be coordinated. Within JACKS beauty GmbH, only those persons who need the data for the proper course of our application process have access to your data.

13. Ddigital product advice

As part of a joint processing according to Art. 26 GDPR, we have integrated the Woow Club widget on our site for automated product advice. To use the advice, the customer must register with Woow Club GmbH, Pettenkoferstraße 4E, 10247 Berlin, during the process. The customer thereby enters into a usage agreement with Woow Club GmbH. Insofar as the customer uses the automated product advice, your data will be:

▪ Email Address

▪ Color Type Tag (we create this tag using the selfie and the information on hair color, eye color, skin tone)

According to Art. 6 para. 1 lit. b GDPR transmitted to us by Woow Club GmbH.

Our use of the data is based on our legitimate interest in the appropriate presentation of our products according to Art. 6 para. 1 lit. f GDPR.

Personal data is stored as long as it is necessary to fulfill the processing purpose. The data is deleted as soon as it is no longer required for the purpose.

14. Digital Voucher

The general limitation period applies to digital gift vouchers. They expire three years after the purchase date. 

15. Promotions and Free Products

JACKS beauty line reserves the right to make short-term changes to promotion details. The promotion conditions for discounts and free products apply only while supplies last.

16. Set Creator

The Set Creator is an online tool that allows customers to receive tiered discounts on selected products. The discount amount depends on the number of products chosen. The reduced prices are already visible in the shop – no discount code is required.

The Set Creator is available exclusively online; the discounts do not apply to in-store purchases.

Changes & Special Cases: JACKS beauty line reserves the right to make short-term changes to the promotion details. The promotion conditions apply only while supplies last. 

17. Online Auctions (binding bids)

17.1. Scope

For selected products, the seller can offer online auctions in addition to the regular ordering process. The following conditions apply additionally to these auctions. Otherwise, the terms and conditions remain unchanged.

17.2. Auction Offer and Duration

The essential features of the auction item, any starting price/minimum price, and the duration are derived from the respective auction page in the online shop. Unless otherwise stated on the auction page, the duration is 4 weeks from the auction start. The time displayed in the seller's system (server time) is decisive.

17.3. Participation / Customer Account

Bids can only be placed by customers who use a customer account in the online shop and have reached the age of 18. The seller is entitled to exclude customers from the auction if there is justified suspicion of abuse, manipulation, or false information.

17.4. Placing Bids / Binding Nature

By activating the intended bidding function, the customer submits a binding offer to conclude a purchase contract for the auction item at the bid they placed.
A placed bid is binding until the end of the auction and cannot be unilaterally revoked or withdrawn unless there is a legal right to contest/withdraw under the legal conditions.
Until the auction ends, the customer can place a new bid at any time. The highest valid bid is decisive.

17.5. Auction End / Highest Bid

The auction automatically ends when the period specified on the auction page expires. The highest bidder is the customer who holds the highest valid bid at the time the auction ends.

17.6. Conclusion of Contract in Auctions

The purchase contract is concluded when the seller accepts the highest bid after the auction ends. Acceptance occurs through an explicit notification (e.g., winning/confirmation email) or at the latest by shipping the goods or through an explicit order confirmation/invoice dispatch. (Section 2 of these terms and conditions applies accordingly as a supplement.)

17.7. Price, Shipping Costs, Payment

The purchase price corresponds to the highest bid (winning price). The price information and shipping cost regulations of these terms and conditions apply accordingly (see especially section 4).
The seller can request payment from the highest bidder after the auction ends. Please pay the invoice amount within 3 calendar days after receiving the payment request, unless a different deadline is specified on the auction page.
If payment is not made on time, the seller may withdraw from the contract after an unsuccessful deadline and offer the item again; further legal rights remain unaffected.

17.8. Invalid Bids / Technical Malfunctions / Cancellation

The seller strives for a smooth auction process. However, technical malfunctions (e.g., system failures, transmission errors) cannot be excluded.
The seller is entitled to interrupt, prematurely end, or repeat an auction for an important reason if necessary to protect legitimate interests (e.g., in case of technical malfunctions, suspicion of abuse/manipulation, obvious errors in the auction description). In these cases, a contract is only concluded if the seller explicitly accepts the highest bid.

17.9. Consumer Rights / Withdrawal

If the customer, as a consumer, has a statutory right of withdrawal, this is governed by the legal provisions and the seller's withdrawal information. (Exclusion of the right of withdrawal only applies if the legal requirements are met in the individual case.)

18. Partner Program

18.1 Usage Restriction for Discounted Products

By participating in the affiliate program, also called the partner program, of JACKS beauty line, the participant confirms that products obtained through the personal partner code are intended exclusively for private personal use. This applies both to the initial equipment and to all further orders placed via the partner code, including products used professionally as a Make-up Artist.
Resale of these products, in any form and by any means, is expressly prohibited. In the event of a violation of this usage restriction, JACKS beauty line reserves the right to terminate participation in the partner program with immediate effect and to claim any damages incurred.

19. Sweepstakes

19.1 Scope
JACKS beauty GmbH (hereinafter "JACKS") occasionally organizes sweepstakes on its digital channels as well as within the JACKS Club loyalty program. In addition to these terms and conditions, the specific participation conditions valid for each sweepstake apply, which are published in the respective communication (e.g., newsletter, social media post, JACKS Club area).

19.2 Participation

Participation in sweepstakes is voluntary. Unless otherwise stated, participation is limited to natural persons aged 18 and over who reside in Germany, Austria, or Switzerland. Participation through third parties, automated systems, or multiple registrations with the same first and last name is excluded. Only one entry per person per sweepstake is allowed, unless the specific terms of the promotion provide otherwise.
Employees of JACKS beauty GmbH and their relatives are excluded from participating in sweepstakes.

19.3 JACKS Club-Exclusive Sweepstakes

JACKS can only offer sweepstakes to members of the JACKS Club loyalty program. Eligibility to participate in these cases requires an active JACKS Club membership at the time of participation. The applicable conditions are announced in the respective communication (e.g., newsletter, JACKS Club area).

19.4 Determination of Winners and Notification

Winners will be determined after the campaign period by random selection or according to the criteria described in the campaign-specific conditions. Winners will be notified by email to the address registered with JACKS. If a winner does not respond within 14 days of notification, the prize will expire and a replacement winner may be selected.

19.5 Exclusion, Liability, and Other Notes

Legal recourse is excluded. Cash payment or exchange of prizes is not possible. JACKS reserves the right to terminate or modify competitions early for good cause. Liability for technical malfunctions or transmission errors that prevent or impair participation is excluded. Participation in a competition does not establish membership in the JACKS Club or any contractual relationship beyond that.

19.6 Note on Social Media Platforms

If competitions are conducted or promoted via social media platforms (e.g., Instagram, Facebook), these are not connected to the respective platform operators (e.g., Meta Platforms Ireland Ltd.) and are neither sponsored, supported, nor organized by them. The contact person for the competition is exclusively JACKS beauty GmbH. Questions, comments, or complaints should be directed directly to JACKS at support@jacks-beautyline.com.

19.7 Data Protection

The personal data collected during competitions (in particular name and email address) is processed solely on the basis of Art. 6 para. 1 lit. b GDPR for the purpose of conducting the respective competition as well as for notification and contact in the event of winning. After the end of the campaign, the data will be deleted unless there is a legal retention obligation. No data will be passed on to third parties. Participation requires that participants consent to the processing of their personal data for the stated purpose. Further information on data processing can be found in our Privacy Policy.

JACKS Store – Rotherstraße 16, 10245 Berlin

1. Exchange and return

1.1 Right of return

Customers have the right to return unused and unopened products purchased in the JACKS Store within 14 days of the purchase date at the JACKS Store.

1.2 Requirements

For a return, the purchase receipt (sent by email) or the order number is required.

1.3 Used products

Already opened or used products are excluded from returns for hygiene reasons. This also applies in case of incompatibilities.

1.4 Refund

A full refund of the purchase price will be made for the return of unused and unopened products within 14 days.

2. Exchange and return between store and online shop

2.1 Store purchases

Products purchased in the JACK Store can only be exchanged or returned there.

2.2 Customers outside Berlin

If customers live outside Berlin and wish to return items, please send the goods purchased in the store at your own expense to the JACKS Store at Rotherstraße 16, 10245 Berlin. The purchase price will be refunded for unused and unopened goods. The desired product can be purchased again by placing a new order in the online shop. 

3. Discounts and price advantages

3.1 Validity of discounts

Discounts available in the online shop for pre-configured sets as well as sale discounts can also be applied in the store. 

3.2 Exceptions

Discounts offered as part of paid marketing campaigns (e.g., Google and Meta Ads) are excluded from this. This also applies to the Set Creator.

4. JACKS Club

4.1 Collect points

Members of the JACKS Club can collect points with every purchase in the store.

4.2 Redeem points

Redeeming JACKS Club points is currently not possible in the store.

4.3 New registration

New registration in the JACKS Club is only possible via the website at https://jacks-beautyline.com/pages/jacks-club possible. 

5. Payment

Cash payment is not possible in the store; only card payments are accepted.

6. Gift vouchers

Digital gift vouchers from JACKS beauty line are available both online and in the store and can also be redeemed in the store.

7. Disclaimer for advice in the store 

Our staff in the store will be happy to advise you individually. Please note, however, that JACKS beauty line assumes no liability for any incompatibilities or incorrect color choices.

8. Workshops in the JACKS Store

8.1 Booking and payment

Booking a workshop is possible up to three days before the desired date and is done through the external booking tool Calendly, which can be accessed via the Workshop page can be accessed. Payment is made exclusively in advance via PayPal.

8.2. Cancellation

If you want to cancel or rebook your appointment, you can do so free of charge up to 24 hours before the agreed time. For later cancellations, a refund is not possible, but the appointment can be rescheduled to a later date. 

If JACKS beauty line has to cancel a workshop, you will be informed immediately by email. In this case, you can rebook the appointment free of charge or request your money back. For a refund or rebooking, you can contact our customer service via the Contact form contact.

8.3. JACKS Club

As a JACKS Club member, you will receive a 10 € voucher after your workshop, which you can use directly with your purchase in the store. However, JACKS Club points cannot be collected for booking a workshop. 

8.4 Venue

All workshops take place exclusively on-site at the JACKS Store at Rotherstraße 16, 10245 Berlin.

8.5 Pickup and shipping of the workshop brushes

After about 8 weeks, you can pick up the finished brush at our studio (Rotherstraße 16, 10245 Berlin).

If personal pickup is not possible, we offer the following shipping:
  • 5 € within Germany
  • 8 € to Austria
  • Shipping to Switzerland is unfortunately not possible

9. Events

9.1 Ticket purchase and contract conclusion

By purchasing a ticket for an event from JACKS beauty line, a binding contract for participation in the booked event is concluded.

9.2 No right of withdrawal

For contracts to provide services related to leisure activities, if a specific date or period is set for the service, there is no right of withdrawal according to § 312g para. 2 no. 9 BGB. Therefore, a ticket once purchased cannot be canceled or returned without a legal reason.

9.3 Cancellation or rescheduling of the event

If an event by JACKS beauty line is canceled, the ticket price already paid will be fully refunded.
In the event of a rescheduling, the tickets remain valid; participants have the right to attend the new date or withdraw from the contract and receive a refund of the ticket price.

9.4 Refunds beyond legal claims

A refund of the ticket price beyond the cases mentioned in section 9.3 is excluded.
JACKS beauty line may, at its own discretion, offer rebookings to other dates or issue vouchers as a gesture of goodwill. However, there is no entitlement to this.
